HOMELINK INTERNATIONAL TERMS, CONDITIONS AND PRIVACY POLICY

1 – DEFINITION OF TERMS – PREAMBLE

Use of the website www.homelink.org (the “Site”) operated by HomeLink International Associates (HLIA) requires your acceptance of the HomeLink Terms & Conditions, including our Privacy Policy below. We reserve the right to amend these Terms & Conditions when necessary at our discretion without prior notice. It is your responsibility to periodically review this page for updates to our Terms & Conditions, which shall come into effect once posted. Your continued use of the Site will be considered as the acceptance of these Terms & Conditions, including our Privacy Policy. If you do not accept these Terms & Conditions please leave the Site now.

If you are a current HomeLink Member or HomeLink Trial Member and do not accept these Terms & Conditions please notify your designated HomeLink representative of your intent to cancel your HomeLink membership or HomeLink Trial membership now.

All references to “HLIA” ‘our’, ‘us’ or ‘we’ within these Terms & Conditions refer to HomeLink International Associates. The terms ‘You’, ‘Your’, ‘Yourself’ means any person who accesses the Site, whether as a registered or a non-registered guest. All references to “Member(s)” include both paid and free trial members.

2 – WHAT IS HOMELINK?

HomeLink International Associates (HLIA) is an international non-profit association, based in Brussels, Belgium. Our “Site” is a platform that enables members around the world to exchange homes. This platform provides the space where members can showcase their home for exchange (by providing information on their home listing and on their profile page). Members may actively find homes for exchange, by using the Site’s search criteria. Each member is responsible for finding the home exchange(s) that suit their travel plans and family needs. HomeLink does not interfere with the organization of the exchange and assumes no liability arising therefrom. Notwithstanding, we reserve the right to cancel any member’s account if he/she fails to comply with these Terms & Conditions or our Privacy Policy.

3 – USE OF THE SITE

There are three ways of using the Site. a). As a non-registered visitor: b). As a Trial member: c). As a fully paid up member.

As a non-registered visitor you will be able to view a limited amount of information concerning the exchange homes. Trial members will have full access to members’ listings and will be able to make contact with other members for a limited period.

Fully paid up membership entitles members to full access to all other members’ home listings, profile information and will be able to contact other members via the HomeLink internal messaging system.

Personal email addresses and phone numbers are not accessible. However, where a member includes it, a phone number appears on the Exchange Agreement

In addition, paid members benefit from the HomeLink network of support, including the on-line Exchange Agreement Form, the Exchange Evaluation Form, as well as assistance from their designated HomeLink representative(s).

Free trial members must pay and register for membership in order to proceed with an exchange and to access our Exchange Agreement and Evaluation Forms.

4 – HOW TO BECOME A MEMBER

To become a HomeLink member it is necessary to register and to pay the appropriate subscription fee. Exception – Free Trial membership where no fee is paid for a limited period is open to new members only.

5 – RIGHTS OF THE MEMBERS

Members can exchange homes as many times, with as many partners, and for as long as they wish, during the validity of their HomeLink paid membership.
Members have a personal listing page to showcase their home, using photos and text.
Members can list additional homes at no extra cost.
Members will receive e-mail alerts from HomeLink at their personal email addresses with home exchange suggestions based on their desired dates and destinations and their selection to opt into these alerts under our Terms and Conditions.
Members will also receive e-mail notifications from HomeLink at your personal email address in the following scenarios:
– message received at your HomeLink Inbox
– Exchange Agreement Form awaiting your response
– Membership renewal Reminders and Newsletters
If members move or sell their property, they may transfer their subscription to their new home at no extra cost. However, they must inform their local HomeLink representative of the change in order that the change to the home can be registered in our database.

6 – OBLIGATIONS OF THE MEMBERS

Members must be of legal age in their country of residence and in the country from which they are accessing the Site. If members do not fall within this category, they may be in breach of laws or regulations applicable in their country of residence or in their country of access and they should leave the Site immediately.

Member’s service subscription is for their sole, personal use. Members may not authorize others to use their membership, and except as otherwise expressly provided in the section entitled “Right to Assign” below, they may not assign or otherwise transfer their account to any other person or entity.
Members will accurately describe their home and exchange wishes. This includes an accurate description of the type of home, sleeping capacity, and number of bathrooms. Any interior or exterior photos posted must be of the property offered for exchange, unless specifically indicated otherwise. Omissions of relevant descriptions may be considered the same as an inaccurate description and subject the member to removal from the Site.
Members will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through this Site, other than the posting of their home for exchange or contacting other members to propose an exchange. Postings shall not contain any type of advertising or solicitation other than an offer to exchange in accordance with these Terms & Conditions. No inquiries or responses between members shall contain any type of advertising or solicitation other than discussions relating to the non-commercial exchange of a member’s home in accordance herewith.
Members will abide by the HomeLink 10 Principles for a Successful Home Exchange.
Members will treat other members and their property with courtesy and respect.
Members will notify their exchange partner of any damage and offer to replace, repair or pay for the same
Members will honor all obligations they make relative to the exchange. Cancelling or otherwise changing the dates of the exchange can be permitted only under the most compelling circumstances
If members are forced to cancel or change the exchange, they will make every effort to otherwise accommodate or find accommodations for their exchange partner
Members will not provide false or misleading information to other members
Members will not use this Site to violate any applicable law
Members will not upload or transmit any files that contain viruses, corrupted files, Trojan horses, malicious code, or any other similar software or programs that may harm the operation of another’s computer or gain otherwise unauthorized access to the computer
Members will assume all liability for use of any information they find on the Site
Members understand that HomeLink assumes no responsibility and in no way guarantees the accuracy of the information contained in any of the pages published in this site. Should a member uncover false information, this should be reported to HomeLink.
Members are responsible for uploading and ensuring the accuracy of their specific listing data (address, email address, mobile number, home details, etc).
Members are responsible for investigating and adhering to all local regulations including, but not limited to, permits, licenses, occupancy taxes, zoning, rules and restrictions applicable to co-ops, condominiums and other common interest developments, and safety compliance
Members acknowledge that features, parameters or other services provided by HomeLink may change at any time
Members may not use any content from this Site for any solicitations or for any commercial use.
It is the responsibility of members to verify their own insurance coverage and the coverage provided by their exchange partner, including auto, property and liability
Members acknowledge that we reserve the right to cancel any member’s account if he/she fails to comply with these Terms & Conditions or our Privacy Policy.
Members agree that HomeLink may use the information provided in the profile of the member outside of its platform with the objective of bringing traffic to the site and increasing the possibility of home exchanges for all members in the community.

7 – DISAGREEMENTS BETWEEN MEMBERS

Any disagreements arising from the use of the Site or affiliate web sites must be settled between the parties who directly participated in the exchange. HomeLink cannot be held responsible for any events that occur as a result of any home exchange that is or was listed on the Site. HomeLink will offer to mediate disagreements between members without assuming any responsibility for subsequent resolution or failure to resolve. HomeLink may terminate or suspend, temporarily or permanently, the memberships of any members involved in an unresolved disagreement. No refunds will be provided in the event of such suspension or termination.

8 – RIGHT TO TERMINATE MEMBERSHIP

HomeLink reserves the right to cancel any membership for any reason, including misuse of the Site, any action we feel compromises the security of the Site, any action that adversely affects other members or their property, or any action we feel is detrimental to HomeLink. We further reserve the right to cancel a membership if we determine, at our sole discretion, that you have violated these Terms & Conditions or our posted Privacy Policy. If any information provided by a member is found to be grossly misrepresented, or should the member’s home listing or actions be in violation of any law or any provision of these Terms & Conditions, we reserve the right to remove, at our discretion, the member’s home listing at any time, and/or to terminate the member’s access to the Site, without refund.

9 – RIGHT OF MEMBER TO TERMINATE

Members may “hide” or “publish” their home listing at any time and at no charge, by logging in to their dashboard and choosing that option. Should a member choose to terminate their membership, they may do so by contacting their designated representative. Refunds will not be given when members terminate their membership.

10 – HOMELINK’S LIABILITY

HomeLink is only responsible for publishing home listings of its members on the Site.

To the fullest extent permitted by law we, our officers, directors, employees, agents, and representatives, hereby disclaim all liability for any loss, cost or damage (direct, indirect, consequential or otherwise) suffered by you as a result of your use of the Site or from any computer virus transmitted through the Site, or other sites accessed from this Site, whether such loss, cost or damage arises from our negligence or otherwise and even if we are expressly informed of the possibility of such loss or damage.

Furthermore, HomeLink shall have no responsibility or liability for any direct or indirect injury or damages arising in connection with your use of this Site, including without limitation any physical injury suffered on any listed property or at the hands or by the negligence of any member or other person, and any damages to your property. HomeLink shall not be liable for any lost profits, losses, punitive, incidental or consequential damages or any claim against HomeLink by any other party. Under no circumstances, including but not limited to negligence, shall HomeLink, its suppliers and its third-party agents be liable to you for direct, indirect, incidental, consequential, special, punitive or exemplary damages even if HomeLink has been advised specifically of the possibility of such damages, arising from use of or inability to use the home exchange service or any links or items on the service or any provision of the terms of service. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages. In no event shall HomeLink be liable for any amount in excess of the membership fees paid by the member.

The HomeLink network is based on mutual trust. HomeLink does not verify the existence or content of any property and does not guarantee an exchange of any kind. HomeLink is not responsible for the accuracy of the home listings or the actions of members, and claims no responsibility for the accuracy, content, or availability of information accessed or linked to through use of this service.

As required under GDPR (General Data Protection Regulation), HomeLink is committed to protecting your personal data and will implement appropriate technical and organisational security measures to protect it against any unauthorised or unlawful processing and against any accidental loss, destruction, or damage.

11 – CONTENT OF THE SITE

All rights for all material and content (including, but not limited to text, images, web pages, sound, software (including, code, interface and website structure) and video, (including the look and feel, design and compilation thereof) on this Site are owned by us or our licensors. You agree that you are permitted to use this material and/or content only as set out in these Terms & Conditions or as otherwise expressly authorized in writing by us or our licensors, and that you may not otherwise copy, reproduce, transmit, publicly perform, distribute, commercially exploit, adapt, translate, modify, bundle, merge, share or make available to any person, or create derivative works of such material or content.

All content within this Site, including information in each home listing, is available to the users of this Site for the express purpose of arranging direct home exchanges between members.

You are solely responsible for your interactions with other members. This Site is a service of a private membership organization, and information contained herein is private and not in the public domain. All this information is secured according to GDPR.

Members may not use any content from this Site for any solicitations, or for any commercial use. Data mining of information from this Site, and collecting or storing personal information about members, is prohibited. Email correspondence (via HomeLink internal message system) is for the purpose of arranging an exchange between members of the Site. Initial contact is limited to using the supplied contact forms on the Site. Any attempt to collect email addresses from members and email individual members or groups of members for any purpose other than arranging a personal home exchange under the auspices of HLIA and during the period of valid membership is in violation of these Terms & Conditions and is subject to suspension or expulsion from the Site. Any violation of this paragraph shall subject the violator to severe penalties. Please note, the display of a private email address within your messages sent to other HomeLink Members through our website or within the published area of your listing, is not permitted. HomeLink reserves the right to remove all such addresses from the site at any time.

12 – INTELLECTUAL PROPERTY OF THE SITE

HLIA is the owner and/or authorized user of all trademarks, service marks, design marks, patents, copyrights, database rights and all other intellectual property appearing on or contained within the Site, unless otherwise indicated. Except as provided in these Terms & Conditions, the use of the Site does not grant you any right, title, interest or license to any such intellectual property you may access on the Site.

You may view the Site and you are welcome to: print hard copies of material, distribute material on it via the ’email’, ‘link’, ‘download’ and ’embed’ functionality on the Site, but solely for your lawful, personal, non-commercial use. Except as provided in these Terms & Conditions, any other use or reproduction of the intellectual property is prohibited.

13 – ACCEPTABLE USAGE POLICY

The opinions, advice, statements, offers or other information or content made available through this Site are not necessarily ours. Any statements, advice and opinions made by other participants are those of such participants only. Such authors are solely responsible for such content.

We do not guarantee the accuracy, completeness, or usefulness of any information on this Site, and we neither adopt nor endorse, nor assume responsibility for the accuracy or reliability of any opinion, advice, or statement made by any party other than us. Under no circumstances are we responsible for any loss or damage resulting from any person’s reliance on information or other content posted on the Site or transmitted to members.

We do not exercise editorial control over the content of any third party sites, electronic mail transmission, text message or other material created or accessible over or through the Site. As a result, you may be exposed to content on the Site accessible over or through the Site that you find offensive or objectionable. Due to the global nature of the Internet, users hereby agree to comply with all local rules regarding on-line conduct and acceptable content. Users also agree to comply with any applicable rules regarding the export of any data from any country.

14 – SAFETY FROM VIRUSES OR UNAUTHORIZED ACCESS AND USE

Unfortunately, we are unable to warrant that the Site will be free from viruses. Although we take all available steps to secure the Site, you acknowledge that the Internet is not a completely secure medium and we make no warranties, express or implied, that any information or materials you post on or transmit through the Site will be totally safe from unauthorized access or use.

15 – USER INFORMATION

In the course of your use of the Site, you may be asked to provide personal information to us (such information referred to hereinafter as “User Information”). Our information collection and user policies with respect to such User Information are set forth in the Site Privacy Policy. This Privacy Policy is incorporated in these Terms & Conditions by reference. You acknowledge and agree that you are solely responsible for the accuracy and content of the User Information.

16 – LINKS FROM AND TO THE SITE

You acknowledge and agree that we have no responsibility for the information provided by Web sites to which you may link from this Site (“Linked Sites”). Links to Linked Sites do not constitute an endorsement by or association with us of such sites or the content, products, advertising or other materials presented on such sites. We have no control over these Linked Sites and do not edit or monitor them. You acknowledge and agree that we are not responsible or liable, directly or indirectly, for any damage, loss or cost caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on such Linked Sites.

17 – THIRD PARTY GOODS AND SERVICES

We do not vouch for those persons, companies and other organizations whose goods or services may be accessed or displayed through or on the Site, by way of Linked Sites or other.

18 – INDEMNITY

You will indemnify us against any loss, damage or cost incurred by us arising out of your use of the Site, any of its services or any information accessible over or through the Site, including information obtained from linked sites, your submission or transmission of information or material on or through the Site or the violation of these Terms & Conditions or any other laws, regulations and rules by you or anyone using your computer (or account, where applicable).

Specifically, members agree to indemnify and hold harmless HLIA, its officers, directors, shareholders, and agents, from any injury or damage suffered directly or indirectly as a result of your use of HLIA home exchange service, including but not limited to (i) any claims for injury or damage to person or property arising from a property a member owns, (ii) any claims for injury or damage to person or property arising from a property transaction, (iii) a claim that any use of the home exchange service by members or someone using their computer (or account, where applicable) infringes any property right of any third party, (iv) any misrepresentation by members, or (v) any breach of any agreement to be performed by members. Members agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable attorneys’ fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, and action or proceeding attributable to any such claim.

You will also indemnify against any claims that information or material which you have submitted to us is in violation of any law or in breach of any third party rights (including, but not limited to, claims in respect of defamation, invasion of privacy, breach of confidence, infringement of copyright or infringement of any other intellectual property right). We reserve the right to exclusively defend and control any claims arising from the above and any such indemnification matters and that you will fully cooperate with us in any such defenses.

19 – ANTI-SPAM POLICY

HLIA does not participate in or tolerate the sending of unsolicited commercial email (SPAM). HLIA reserves the right to cancel (without refund) any member that mentions HLIA or any of its associated websites, URLs, or any associated HLIA email address in any SPAM e-mail message. In addition, HLIA reserves the right to cancel (without refund) any member that uses HLIA to send any solicitations other than personal, non-monetary exchange requests or replies

20 – RESTRICTION, SUSPENSION AND TERMINATION

We may restrict, suspend or terminate your access to the Site and/or your ability to avail of any of the services on the Site, if we believe that you have breached these Terms & Conditions at any time. Any such restriction, suspension or termination will be without prejudice to any rights, which we may have against you in respect of your breach of these Terms & Conditions. We may also remove the Site as a whole or any sections or features of the Site at any time. Please note that we have the ability to trace your IP address and if necessary contact your ISP in the event of a suspected breach of these Terms & Conditions.

21 – ENTIRE AGREEMENT

Under GDPR, these Terms & Conditions, including our Privacy Policy, constitute the entire agreement between you and us in relation to its subject matter and supersedes any and all prior promises, representations, agreements, statements and understandings whatsoever between us. To the extent that software is available through the Site, such software may be subject to a license agreement that is distributed or included with such software, and you agree to abide by the terms and conditions of any such license agreements. The failure by us to exercise or enforce any right or provision of the Terms & Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms & Conditions is found by a Court of competent jurisdiction to be unenforceable or invalid, the parties nevertheless agree that the Court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms & Conditions shall remain in full force and effect.

22 – LAW AND JURISDICTION

These Terms & Conditions, including the Privacy Policy and any matter relating to this Site, shall be governed by Belgian law and any legal action will be brought exclusively to Brussels, Belgium.

INTRODUCTION

Any use by you of the website operated by HomeLink International Associates (HLIA) at www.homelink.org (the ‘Site’) is conditional upon your acceptance of this Privacy Policy.

All references to ‘HLIA, ‘our’, ‘us’, ‘we’, ‘the Site’ or ‘company’ in this policy refer to HomeLink International Associates. We endeavor to protect your personal privacy. We provide this privacy statement in order to inform you of what we may do with any personal information that we obtain from you. By supplying us with your personal details, you signify your acceptance of our Privacy Statement. If you do not agree with this statement, please do not provide us with your personal details. This privacy statement is incorporated in the Terms and Conditions which govern your use of the Site as a whole. We will use your information for the purposes set out below. You will be given an opportunity to unsubscribe at any time. We may need to update this privacy statement from time to time. We recommend that you regularly check this page to ensure that you have read the most recent version.

LEGAL AGE

You must not provide us with your personal information if you are not of legal age to do so in the jurisdiction in which you reside or (if different) in the jurisdiction from which you are accessing the Site. We do not intend to collect personal information from any individuals under the legal age. If we receive notice or believe that someone under the legal age has provided us with personal information we will make every reasonable effort to remove such personal information from our files.

WHAT IS PERSONAL INFORMATION?

Personal information is information about an identifiable individual, as defined by applicable law.

COLLECTING PERSONAL INFORMATION

You can decide what personal information you provide to us. We will only retain personal information that you choose to provide. Where possible, we will enable you to select how we will use this information, for example, by choosing to opt in or out of receiving information from us.

You may choose to provide us with personal information if, for example, you: contact us with an enquiry, register on the Site as a member, fill out a survey or other form with your personal information, request us to provide you with information, enter a competition, post information to public areas of the Site, or take advantage of a promotion. By providing any personal information to us, you fully understand and clearly consent to the transfer of such personal information to, and the collection and processing of such information in other countries or territories for the purposes of enabling you to engage in exchanging homes.
Any such transfer and processing by us will be in accordance with this Privacy Statement and requirements under GDPR. In circumstances where you provide us with information relating to any third parties, you affirm that you have received that third party’s consent in relation to such disclosure and that the third party has been informed of, and agree to, our Privacy Policy and the uses, which we may make of such information.

RETENTION OF YOUR INFORMATION

As require under GDPR, we will retain your personal data only for as long as is necessary for the purposes for which it was collected and in order to meet the legal and business requirements of managing your membership and experience with us.

Under GDPR, HomeLink shall retain former members’ listing information, both public and personally identifiable, for 5 years following the members’ last subscription year to our service.
Member may request all information be deleted from our database upon membership expiration or at any other time, by contacting their designated representative, according to GDPR law.

USE OF INFORMATION

We will use information collected from you in the following ways:

Transactional Purposes

We may use your personal information in order to respond to your queries and requests and to manage transactions such as credit card payments for any services that you order from us or any of our agents, or for the fulfillment of such transactions. The personal information you provide may be used only by an authorized third party, contracted by HomeLink both within and outside the EU with verified internet security certificates, to fulfill that order.

Home exchange

Your non-personally-identifying demographic information and your home details and photos are used to allow other members and visitors to find your home through a search or to check the quality and details of your home. Your contact information (e-mail address and telephone number) is never made available to other members or visitors, you can choose to provide members with this information yourself, should you wish to do so. Furthermore, in order to get the most out of our Site as a member, you expressly consent that we use your contact information to regularly forward to you home exchange suggestions according to your chosen preference criteria – (Listing Alerts requested by you, message notifications, etc).

Physical street addresses provided by members will only be published on the exchange agreement form accessible only by paid members. Physical street addresses are visible to members but not to visitors to the site.

Marketing communications

We may use your personal information in order to communicate with you about our services and those of our HomeLink affiliates and parent companies and any of their related businesses.

By accepting the Privacy Policy on registration, you expressly accept to receive information about HLIA news and promotions. You will also be given the opportunity to unsubscribe whenever we communicate with you, and you may unsubscribe from such communications at any time (see “Unsubscribe, access, questions and further information” below).

Marketing analysis

We may use information for internal marketing analysis. We may also share non-personal information with others, in aggregate anonymous form, which means that the information will not contain any personally identifiable information about you.

Public Areas of the Site

Information or pictures that you post on or via the public areas of the Site are generally accessible to, and may be collected and used by, others and may result in unsolicited messages or other contact from others. Users of the Site are encouraged to exercise caution when providing information about themselves or their homes in public areas of the Site.

Social Media

The Site offers the opportunity for members to share information on social media. Consequently, the following limited information on your exchange listing may be posted: photo, title and short description of your home. We disclaim any liability arising from the publication of this information on social media.

Administration and data management

We may transfer your personal information to third parties under confidentiality obligations when the performance of any service in relation to the activities above is sub-contracted (e.g. the administration of a marketing campaign or IT support).

Legal purposes

We may collect, use or disclose your personal information if permitted by law or required to do so by law or where we believe such action is necessary in order to protect or defend us or other third parties against error, negligence, breach of contract, theft, fraud and other illegal or harmful activity, to comply with our audit and security requirements, and to audit compliance with our corporate policies, procedures, legal and contractual obligations.

USE OF COOKIES

In common with many websites, we use ‘cookies’ to help us gather the following information from visitors to the Site. A cookie is a small data file that our server sends to your browser when you visit the Site. The use of cookies helps us to assist your use of certain aspects of the Site. You can delete cookies at any time or you can set your browser to reject or disable cookies. If you do disable cookies, some functions on the Site may not work correctly. In addition to disclosures outlined in the legal purposes above, from time to time we may disclose personal information where:

Engaging data processing and software development companies in relation to HomeLink home exchanging.
Website hosting and management, information technology and office services

a person who, in our reasonable judgment, is providing or seeking the information as the authorized or appointed legal agent of the subject individual
or any third party with your consent or where disclosure is required or permitted by law.

Your acceptance of the Terms and Conditions of use of the Site, which include this Privacy Policy, constitutes a granting of consent to the use and disclosure of your personal information for the purposes set out above.

SECURITY

We take security seriously and take all possible precautions to keep your personal information secure. We have installed the appropriate physical, electronic and managerial procedures to safeguard the information we collect. However, due to the open communication nature of the Internet, we cannot guarantee that communications between you and us, or information stored on our servers, will be free from unauthorized access by third parties.

The Site may contain links or references to other websites outside of our control. Please be aware that we have no control over these sites and this Privacy Statement does not apply to them.
